 note = {P(論文), A sixty-three-year-old homeless man was murdered in Osaka, on 18th October 1995. Two young men were arrested eventually for murder. One of them admitted his crime but the other insisted that he should be innocent. However, in spite of his denial, the young man was taken to court. I attended the court as an auditor from the first trial to the last and noticed that the point which became at crucial issue in court was reliability of confession and that of witnesses. In this paper, I paid attention to the way of constructing lawful "facts" and analyzed how "facts" are admitted as "facts" in court.},
